By signing up for and/or participating in a food session, class or event, identified as (“The session”), hosted in whole, or in part, by WHAT ABOUT DINNER? Inc., or any of its shareholders, officers, employees, agents, representatives, members, and/or franchisees, collectively referred to as “WHAT ABOUT DINNER?”, I hereby agree to the terms and conditions of this Indemnity and Waiver Agreement.

For and in consideration of my participation in any such sessions and/or consumption of products, I hereby Waive any and all responsibility or liability on the part of WHAT ABOUT DINNER? In any manner whatsoever, for every aspect of my participation in all activities undertaken in conjunction with, preparatory to and/or following any and all such session(s).

I understand and agree that I will be responsible for, and assume the risk of, the food handling procedures which I use after any food prepared by me is removed from WHAT ABOUT DINNER? location(s) including, but not limited to, preparation, serving, storing, freezing and refrigeration of the food, condiments, garnishments, sauces, spices or any edible products. WHAT ABOUT DINNER? recommends that all food prepared in connection with the session, be taken home immediately after the session, no later than 40 minutes after leaving the WHAT ABOUT DINNER? Premises, be placed in the freezer, until ready for consumption and following the label instructions.

Further, I do hereby indemnify and hold harmless WHAT ABOUT DINNER? from all responsibility and/or liability for any injuries or damages I sustain, or that anyone affiliated with me in any way may sustain, in connection with or resulting directly or indirectly from my participation in the session and my food handling practices after the conclusion of same.

I have read, understood and agreed to this indemnity and waiver agreement, am free from any duress or undue influence in acknowledging same, no promises or verbal or other inducement has been offered to me or shall have any force or effect and this is the complete and final agreement between WHAT ABOUT DINNER? and successors, my heirs, assigns, and/or me whom I have authority to obligate to the terms of this agreement.

Any and all claims concerning formation, interpretation, enforcement and validity of this agreement shall be governed by binding arbitration, as the sole and exclusive forum for resolving any and all such disputes.
